The New York Times today reports on a surgery that is heroic in scope. Japanese-born Tomoaki Kato, a surgeon at New York Presbyterian Hospital/Columbia led a 43-hour operation to remove a massive tumor(the size of a football) that had engulfed the liver and other vital organs of a 59 year old man who had been told the tumor was inoperable. Dr. Kato is a pioneer in ex vivo resections which are surgeries where the affected organs are taken outside the body, operated on to remove tumors and then sewed back in. In its press release, USCIS did not state how cases filed and rejected on the 2nd are to be handled other than to say that properly filed applications would be accepted. This presumably covers the many cases filed after the second that were held, but it doesn�t explain what will happen to the cases received earlier. We hope USCIS will issue special instructions to issue July 2nd receipt dates to those who are able to document they attempted to file. We presume some folks are still waiting on their July 2nd cases to be returned and are debating refiling new cases rather than waiting. Unfortunately, there is a risk of not getting the package back before August 17th and some people will need to refile without proof of the earlier filing. Hopefully, again, USCIS will institute a process for such individuals to avoid being penalized.

Hello All
Just want to know my options here and here is my scenario:
I am on H1-B and my 6 years of H1B is going to complete on Sep so I have almost 1 more year to complete my 6 years of h1-B
Right now, I have my LC and I-140 approved from my present employer.
Now, I am thinking about moving onto a new job where the new employer is ready to start my GC immediately I take the new job.
My question is:
If I take the new job, would I get my new H-1B for 3 years since my I-140 with old employer/current employer is already approved ?
I do have the copy of my I-140

Other than name check are there any other stuff we should be aware of to get the green card.
With this new 180 day rule can I get my GC even if my Namecheck is not complete in 180 days. Is so once my PD is current and my 485 application has crossed the processing times can i go ahead and demand (please note demand) my green card or should i just leave it to luck and keep waiting hoping i will get it soon. sorry for sounding so sorrowful but the process seems to be very happazard.

Any idea who represented skilled workers in the meeting that happened. I don't see Immigration Voice in the list.
Is IV core looking into how they can how they can be part of such meetings in future. If we are not represented, there wont be anything for us even in the comprehensive immigration reform. We employees cant rely on employers to represent us. That why we are where we are today.

I have the same situatation and called them numerous times. They say they will honour the actual date that is written on the receipt and not on the web site. When you call USCIS, you have to tell them that your receipt date is different than what is displayed on the web stie.

My wife had a H1B working for company A from 08/2003 to 07/2005 (from I-94) and she filed another H1B application to work for company B in 05/2004. She got the notice, stopped working for company A and started working for company B. However, she never got the aprroval notice for the second H1B application. Actually this case is currently still pending. She worked for company B until 07/2005 which is the expiration date of the first H1B. She changed to F2 later in 07/2005. I was wondering if there is any problem about status or employment authorization for this period of time from 08/2003 to 07/2005.

Last month dates were 7 Jan 2005.
This month dates are 22 Jan 2005.
Still the reported Jan 2005 approvals(, IV ) etc are less than 5.
Not sure whats happening to these

Hi,
My i140 was approved 2 months back and now i got a Full time position in another company.
So my question is, after moving to new company if the dates are made current can i still file for i485 with my old employer if he agrees for it?

Hi,
I have been doing a lot of research about this online and have even heard from friends that if you transfer your H1 to H4 and apply again for H1, your new H1 application is not counted against the H1B cap. How true is it? Has some one done this before ? Is there any risk involved? Any help would be really appreciated.

United States Citizenship and Immigration Services (USCIS) released an updated H-1B cap count of 45,100 as of August 28, 2009. This reflects an increase of 100 cases from the prior count, provided on August 14, 2009. The advanced-degree cap remains at 20,000. The USCIS continues to accept FY2010 H1B cases under the advanced-degree and regular caps.
We suggest to US employers to file H-1B Petitions only if they can able to provide the Client details like Letter from the end-client, Work-orders confirming the placement. If you are having an in-house requirement, provide USCIS with ample proof of your in-house requirements. Considering the flood of H-1B RFEs, we have to be bit cautious in filing works. The standard approach prevailing until last year needs a re-look. Be assured, if you are right on papers and abide the Immigration requirement, you will for sure come with flying colors. We will be happy to help and support you in H-1B and other filings. It is widely believed that the H-1B Cap will be available even after Sept. 30, 2009.

I received a RFE regarding medical test because the Civil Surgeon didn't complete some of the forms properly. I replied bak to the RFE few days after I received it (within the allowed time).
my question is how many days does it take USCIS on average to look at my reply to the RFE and make a decision on my I-485 application (my PD is current as of June VB and been current for months now)
if USCIS does not make a decision and if PD retrogresses in July VB and I won't be current, does that mean that USCIS won't make a decision then untill my PD is current again???
Please advise. Thank you
